Terms & Privacy
Effective October 23, 2026
Terms of Use
These Terms of Use govern your use of this website, operated by Heather Honaker, doing business as New Morning Mercy Travel, an Independent Advisor with Travelmation, LLC (“we,” “us,” or “our”). By using this website you agree to these terms. If you do not agree, please do not use the site.
Use of the website
You may use this website for personal, non-commercial purposes such as learning about our services and requesting a travel quote. You agree not to misuse the site, including by attempting to gain unauthorized access, interfering with its operation, submitting false or automated requests, or uploading harmful code.
Information only; no booking contract
Content on this website is for general information. Prices, availability, and destination details change often and are not guaranteed. Submitting the contact form is a request for information and does not create a booking. Any travel booking is governed by a separate written agreement and the terms of the applicable suppliers (cruise lines, resorts, airlines, tour operators, and others).
Third-party suppliers and links
We act as an advisor connecting you with independent travel suppliers. We are not responsible for the acts, omissions, or policies of those suppliers. Links to other websites are provided for convenience; we do not control and are not responsible for their content.
Intellectual property
Text, design, and graphics on this website are owned by us or our licensors and may not be copied or reused without permission.
Disclaimer and limitation of liability
This website is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the website.
Governing law
These terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflict-of-law rules, subject to the Dispute Resolution section below.
Changes
We may update these terms from time to time. The effective date above shows when they last changed.
Privacy Policy
Your privacy matters to us. This policy explains what we collect, why, and the choices you have.
Information we collect
When you submit the contact form we collect the details you choose to provide: name, email address, phone number, trip type, destination, travel dates, number of travelers, budget range, and your message. Our hosting provider may also process standard technical data such as IP address and browser type for security (for example, to prevent spam and abuse).
How we use it
- To respond to your inquiry and plan or quote your trip;
- To send you a confirmation that we received your request;
- To protect the website against fraud, spam, and abuse;
- To comply with legal obligations.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
Sharing
We share information only as needed to serve you: with travel suppliers when you ask us to book or quote travel, with Travelmation, LLC as our host agency, with service providers that host this website and deliver email on our behalf, and when required by law.
Retention and security
We keep inquiry information only as long as needed for the purposes above or as required by law. We use reasonable technical and organizational safeguards, including encrypted connections (HTTPS), input validation, and rate limiting. No method of transmission or storage is completely secure.
Your rights (GDPR)
If you are in the European Economic Area, United Kingdom, or Switzerland, our legal basis for processing is your consent and our legitimate interest in responding to your request. You may request access to, correction of, deletion of, restriction of, or a copy of your personal data, object to processing, and withdraw consent at any time. You may also lodge a complaint with your local data protection authority.
Your rights (California — CCPA/CPRA)
California residents may request to know what personal information we collect and how it is used, request deletion or correction, and opt out of any sale or sharing (we do neither). We will not discriminate against you for exercising these rights.
To make any privacy request, email [email protected]. We will respond within the time required by applicable law.
Children
This website is not directed to children under 13, and we do not knowingly collect their personal information.
Accessibility Statement
We want everyone to be able to explore travel with us. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you have trouble using any part of the site, please email [email protected] and we will gladly help and provide the information in another format. See our full Accessibility page.
Notice & Cure
Before starting any claim or legal proceeding related to this website or our services (including any claim about accessibility or privacy), you agree to first send us a written notice describing the issue and the relief you seek to [email protected]. We will have thirty (30) days from receipt to investigate and, where appropriate, cure the issue. Many concerns can be resolved quickly and informally this way, and we sincerely want to make things right.
Dispute Resolution
Binding arbitration
If a dispute is not resolved through the Notice & Cure process, you and we agree to resolve it by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in Kentucky or, at your election, by video conference. The arbitrator’s decision is final and may be entered in any court with jurisdiction.
Class-action waiver
Disputes will be resolved only on an individual basis. Neither you nor we may bring or participate in a class, collective, consolidated, or representative action.
Jury trial waiver
To the extent any dispute proceeds in court, you and we knowingly and voluntarily waive any right to a trial by jury.
Severability
If any part of this section is found unenforceable, the remainder stays in effect, except that if the class-action waiver is found unenforceable, the arbitration agreement will not apply to that claim.
